General terms and conditions of sale and hire

The purpose of this document is to set out the terms and conditions for hiring the bicycles offered by La Cyclerie.

In the remainder of this document, the contract holder will be referred to as the "user".

The user of the bicycle declares that he/she is fit to cycle and is not aware of any medical contraindications.

Minors must provide an authorisation signed by their legal representative allowing them to hire a bike. The hire company cannot be held responsible for any damage caused by the user's inaptitude.

The bicycles, equipment and accessories are deemed to comply with the regulations in force at the time of hire and to be in good working order. The equipment and accessories are fixed in accordance with safety standards. The user must be

covered by civil liability insurance. The hirer releases La Cyclerie from any liability arising from the use of the rented equipment. This applies in particular to accidents and damage caused to third parties as a result of the use of the bicycle. The equipment hired remains the exclusive property of La Cyclerie for the duration of the loan. The user may not sublet it to a third party. The user is solely responsible for any damage caused to the rented equipment or as a result of its use. The user acknowledges that the equipment loaned is in perfect working order. The user undertakes to use the equipment with care and within the limits of his or her ability, to comply with the instructions for use and safety given to him or her by the hire company, to use the bicycle loaned in its normal conditions and not to carry a person or a load of more than 25 kilos on the luggage rack. The user undertakes to return the bicycle in its original condition on the dates agreed in the contract. The user declares that he/she will abide by the present Highway Code regulations. Should the user contravene the laws and regulations in force during the hire period, La Cyclerie cannot under any circumstances be held responsible. The user undertakes to make every effort to prevent theft or damage to the rented bicycle. To this end, regardless of the length of time the bicycle is parked, the user undertakes to secure it to a fixed point using the anti-theft device provided. In the event of technical failure of the bicycle during the term of the contract, the user may not undertake any repair work on their own initiative. The user must inform the hire company and return the hired bike if possible. At the user's request, the bicycle will be replaced by a bicycle of the same type, subject to availability and in the absence of fault on the part of the user, for the remaining period of the contract. The user may not claim reimbursement of costs or invoices, or damages and interest.

Any aggressive or disrespectful behaviour or refusal to comply with these rules will result in refusal of the rental.

- To take out a hire contract, the user must present proof of identity (identity card, driving licence, passport).

- Lease term, extension, termination :

All rentals, regardless of the duration chosen when the contract is taken out, are payable in full. When returning the bike, the user must arrive at least 10 minutes before the rental service closes. They may then renew or extend their hire period if they wish. In the event of renewal, the user must present the rented bike. For the 2 to 5 hour or full day package, the bike must be returned on the day it was hired.

- Rates and payment terms :

Rental rates, deposits and payment terms are displayed. The prices invoiced are those in force on the day of hire. The hire company reserves the right to change its prices at any time. In this case, the user will be informed at least one month in advance by posting. The new rates will only be applied when the user begins a new rental period. Users are required to pay for their first rental period on the first day of the rental period. If the user wishes to renew their contract, the second rental periods must be paid for before they come into effect. The means of payment accepted by La Cyclerie are credit card, cash, cheques and holiday vouchers.

Before handing over the hired equipment, the user must provide his or her bank card details. When the equipment hire contract is signed, the customer may opt to cover the risk of damage by paying an insurance policy (see conditions displayed in the shop). This option allows the customer to be exonerated from the obligation to reimburse in the event of damage to the rented equipment. This exemption is always subject to an excess (see conditions displayed in the shop and excesses indicated on the rental contract).

The rented bike must be returned no later than the date indicated on the rental contract. The deposit will be returned to the user when the rented equipment is returned. The user may, however, extend the rental period at the current rates. In the event of theft, the user must provide proof to the hire company, within 24 hours of the theft, that a complaint has been lodged with a police station or gendarmerie. A certificate of collection may be provided on request if the user wishes to have the deposit reimbursed by their insurance. If the stolen bike is returned to the hire company, the user who has complied with the above procedure will be reimbursed the amount of the deposit collected, less any costs incurred in repairing the bike (see article 7). If the user does not provide proof that a complaint has been lodged, payment of the value of the new bike will be due immediately. In the event of non-payment of the cost of hiring the equipment or the cost of repairing or reimbursing it on the expiry date of the contract, the customer, by providing his or her bank card details, authorises and expressly mandates the shop to deduct from his or her bank account the sums still due, in accordance with the quotation (hire contract) that he or she signed when taking delivery of the equipment and/or the prices and conditions displayed in the shop.

In the event of failure to comply with the above clauses of the hire contract, or in the event of damage to the hired equipment, the user will be required to pay the following invoices:

- Invoice for the replacement value of the bike, in the event of failure to return it.

Value of equipment if not returned :

Classic bike: 250 euros. VTC, mountain bike, beach cruiser: 350 euros. Trailer: 200 euros. Child seat: 80 euros. Electric bike and tandem: 1000 euros. Electric fatbike and VTTAE: 2000 euros. Children's mountain bikes and crasy bikes: 250 euros. Children's bikes without gears: €100

- Invoice for an amount equivalent to the corresponding repair invoice, in the case of repairs following damage or missing parts.

A receipt will be given to the user on request, once payment has been received.

Opening times will be those of the shop, which can be consulted online or on site.

In accordance with the General Data Protection Regulation (GDPR) adopted by the European Parliament on 14 April 2016, and the Data Protection Act of 6 January

1978 relating to data processing, data files and individual liberties, all persons have the right to access and rectify information concerning them.

In a nutshell:

For the duration of the hire period, the hirer is responsible for the equipment hired in terms of its general condition, accessories and theft. In the event of theft, the hirer must pay the value of the cycle. In the event of damage without an identified third party, the cost of repair will be charged to the hirer.

Insurance and liability

The hirer is always liable for any personal injury or damage to property caused by the use of the rented cycle in his or her care. The equipment is insured for "hire company civil liability". The hirer is only liable for professional negligence. Rentals will not be reimbursed. In the event of an accident: note down the details of the third party and, if possible, fill in an accident report form.

Theft and breakage guarantee

This cover must be taken out on the day of hire. In the event of theft or breakage, you only have to pay an excess of 30% of the market value of the rented model, excluding electric bikes, which are not insurable. This cover is only valid on presentation of the police report. Value of equipment in the event of breakage/theft Classic: 250 euros. VTC, VTT, BEACH: 350 euros. Trailer: 200 euros. General conditions of sale and rental

The purpose of this document is to fix the procedures for locating the bikes offered by La Cyclerie. In the remainder of the document, the subscriber of the contract will be referred to as " the user ".

The bicycle user declares that he is able to practice cycling and that he is not aware of any medical contraindication. Minors must provide an authorization signed by their legal representative allowing them to rent a bicycle. The renter cannot be held responsible for damage or disqualification of the user.

Bikes, equipment and accessories are deemed to comply with the regulations in force at the time of their rental and in good working order. The equipment and accessories are fixed in accordance with safety standards. The user must be covered by liability insurance. It releases the rental company La Cyclerie from any liability arising from the use of the rental equipment. Especially with regard to accidents and damage caused to third parties due to the use of the bicycle. The rented equipment remains the exclusive property of La Cyclerie for the entire duration of the loan. The user cannot sublet them to a third party. The user is solely responsible for any damage caused to the rented equipment or due to its use. The user acknowledges that the equipment loaned is in perfect working order. The user undertakes to use the equipment with care and within the limits of his capacities, to respect the usage and safety instructions which will be sent to him by the rental company, to use the loaned bicycle under its normal conditions and not to carry a person or a load weighing more than 25 kg on the luggage rack. He undertakes to return the bicycle in its original condition on the dates agreed in the contract. 

The user declares to submit to the traffic laws. If it contravenes the laws and regulations in force during the rental, the rental company La Cyclerie can't be held liable. The user agrees to do everything to avoid theft or damage to the rented bike. For this purpose, whatever the duration of the bicycle parking, he commits himself to park it at a fixed point using the anti-theft device provided. In the event of a technical failure of the bicycle during the contract, the user may not undertake repair work on his own initiative. He must inform the owner and bring the rented bike back if possible. At his request the bicycle will be replaced by a bicycle of the same type, subject to availability and in the absence of faulty responsibility of the user, for the period remaining to run. The user will not be able to claim either the reimbursement of costs or invoice, or damages. Any aggressive, disrespectful behaviour or refusal to comply with these rules will result in the rental being refused.

- In order to take out a rental contract, the user must present proof of identity (identity card, driving licence, passport)

- Rental period, extension, termination: Any rental, regardless of the duration chosen when the contract is taken out, is due in full. When returning the bicycle, the user must come no later than 10 minutes before the rental service closes. He can then, if he wishes, renew or extend his rental. In the event of renewal, the user must present the rented bicycle. For the formula 2 to 5 hours of time or day, the bicycle must be returned the same day of its rental.

- Rates and payment methods: Rental prices, deposits and payment terms are displayed. The prices invoiced are those of the tariffs in force on the day of rental, the lessor reserves the right to modify its tariffs at any time. In this case, the user will be informed at least one month in advance by posting. The new rates will only be applied when the user starts a new rental period. The user is required to pay his first rental period on the day D begins rental. If the user wishes to renew his contract, the second rental periods must be paid before their entry into force.

Prior to the delivery of the rented equipment, the user must provide their bank card information. At the signing of the equipment rental contract, the customer can choose to cover the risks of deterioration by paying insurance (see conditions displayed at the store). This option allows the customer to be exempt from the obligation to reimburse in the event of damage to the rented equipment. This acquired exemption is always accompanied by a deductible (see the conditions displayed in stores and deductibles indicated on the rental contract).

The rented bike must imperatively be returned at the latest on the day indicated on the rental contract. The deposit will be returned to the user when the rented equipment is returned. The user may, however, extend his rental in view of the current prices. In the event of theft, the user must justify to the lessor, within 24 hours after the flight, of a complaint made within 24 hours to a police or gendarmerie station. It can be provided to him, upon request, a collection certificate if the user wishes to have the deposit reimbursed by his insurance. If the stolen bicycle is returned to the rental company, the user who has complied with the above procedure will be reimbursed the amount of the deposit collected, minus any costs of repairing the bicycle (see article 7). If the user does not justify a complaint, the settlement of the value of the new bicycle will be due immediately. In the event of non-payment of the cost of renting the equipment or the costs of repairing or reimbursing it, at the end of the contract, the customer, by submitting his bank card information, authorizes and gives express mandate to store to debit from his bank account the sums which will remain due, in accordance with the estimate (rental contract) which he himself will have signed when he picked up the equipment and / or at the price and conditions displayed in the store.

In case of non-compliance with the previous clauses of the rental contract, or in case of damage to the rented equipment, the user will have to pay the following invoices: - Invoice of the market value of the bicycle, in the event of a failure to return the bicycle. Value of the equipment in the event of non-return: Classic bike: 250 euros. Mountain bike, mountain bike, Beach cruiser: 350 euros. Trailer: 200 euros. Child seat: 80 euros. Electric bike and tandem: 1000 euros. Fatbike electric and E Mountain Bike : 2000 €. Children's mountain bikes and crasy bikes: 250 euros. Children's bike without speed 100 € - Invoice of an amount equivalent to the corresponding repair invoice, in the case of repairs following damage or missing parts. A receipt will be given to the user upon request, once the payment has been received.

The hours will be those of the store, available online or on site.

During the rental period, the hirer is responsible for the rented equipment: general condition of the bike, accessories and theft. In case of theft, the hirer will have to pay for the value of the bike. In case of damage without identified third party, the hirer will pay for the repairs.

Insurance and responsibility

The hirer is always responsible for the physical injuries or the material damages he has caused when he uses the rented bike. The equipment is insured by the rental agency (French "responsabilité civile du loueur") under certain conditions and the agent is responsible only for professional misconduct. The payment for the rental bikes cannot be refunded. In case of accident, inquire about the third party's name and address and if possible, fill in a jointly-agreed statement for insurance purposes (French "contrat à l'amiable").

Theft and damages guarantee

This guarantee must be subscribed on the day of the renting. In case of theft or damages, a maximum amount of 30% of the bike's value will be paid by the hirer (deducted from his security deposit). This guarantee is only valid on presentation of the complaint-form and the return of the key replicas of the lock. Prices list in case of break and stole Clasiq bike : 250 euros. VTC, VTT, BEACH : 350 euros. Kids trailer : 200 euros. Seat for kid : 80 euros. Electric bike : 1000 euros. Fatbike and E Mountain Bike : 2000€. Mountain bike kids : 250 euros. Kids : 100 euros.

El usuario de la bicicleta declara que puede pracar ciclismo y que no tiene conocimiento de ninguna contraindicación médica. Children must present an authorisation signed by their legal representative allowing them to ride a bicycle. El arrendatario no se hace responsable por daños o descalificación del usuario.

Se considera que las bicicletas, los equipos y los accesorios cumplen con la normativa vigente en el momento de su alquiler y en buen estado de funcionamiento. Los equipos y accesorios se fijan de acuerdo con las normas de seguridad. El usuario debe ser cubierto por seguro de responsabilidad civil. Libera a la compañía de alquiler La Cyclerie de cualquier responsabilidad derivada del uso del equipo de alquiler. Especialmente con respecto a accidentes y daños causados a terceros por el uso de la bicicleta. El equipo alquilado sigue siendo propiedad exclusiva de La Cyclerie durante toda la duración del préstamo. El usuario no puede subarrendarlos a un tercero. El usuario es el único responsable de cualquier daño causado al equipo alquilado o debido a su uso. El usuario reconoce que el equipo prestado está en perfecto estado de funcionamiento. El usuario se compromete a utilizar el equipo con cuidado y dentro de los límites de sus capacidades, a respetar las instrucciones de uso y seguridad que le enviará la empresa de alquiler, a utilizar la bicicleta prestada en sus condiciones normales y no a No transporte una persona o una carga que pese más de 25 kg en el portaequipajes. Se le puede proporcionar, previa solicitud, un certificado de cobro si el usuario desea que el seguro reembolse el depósito. Si la bicicleta robada se devuelve a la empresa de alquiler, al usuario que haya cumplido con el procedimiento anterior se le reembolsará el monto del depósito cobrado, menos los costos de reparación de la bicicleta (consulte el artículo 7). Si el usuario no justifica una queja, la liquidación del valor de la nueva bicicleta se deberá pagar de inmediato. En caso de falta de pago del costo de alquilar el equipo o los costos de repararlo o reembolsarlo, al final del contrato, el cliente, al enviar la información de su tarjeta bancaria, autoriza y otorga un mandato expreso a tienda para deducir de su cuenta bancaria las sumas pendientes de pago, de acuerdo con la estimación (contrato de alquiler) que él mismo habrá firmado cuando tomó el equipo y / o al precio y condiciones que se muestran en la tienda.

En caso de incumplimiento de las cláusulas anteriores del contrato de alquiler, o en caso de daños al equipo alquilado, el usuario deberá pagar las siguientes facturas:

- Factura del valor de mercado de la bicicleta, en caso de no devolución la bicicleta. Value of the equipment in the event of non-devolution:

Durante el período de alquiler, el arrendatario es responsable del equipo alquilado: estado general de la bicicleta, accesorios y robo. In the event of damage, the owner must pay the value of the bicycle. En caso de daños sin un tercero identificado, el arrendatario pagará las reparaciones.

Seguros y responsabilidad

El arrendatario siempre es responsable de las lesiones físicas o los daños materiales que ha causado cuando usa la bicicleta alquilada. El equipo está asegurado por la agencia de alquiler bajo ciertas condiciones y el agente es responsable únicamente de la mala conducta profesional. El pago de las bicicletas de alquiler no puede ser reembolsado. En caso de accidente, pregunte sobre el nombre y la dirección del tercero y, si es posible, complete una declaración acordada conjuntamente para fines de seguro (francés "contrat à l'amiable").

Garantía de robo y daños

Esta garantía debe suscribirse el día del alquiler. En caso de robo o daños, el arrendatario pagará una cantidad máxima del 30% del valor de la bicicleta (deducida de su depósito de seguridad). Esta garantía solo es válida con la presentación del formulario de queja y la devolución de las replicas clave de la cerradura.
